I have created this letter after doing some reading here. Is this a good 1st punch at cleaning up some IIB accounts.
To whom it may concern,
I am writing this letter to dispute inaccurate information in my credit report.
The following accounts are currently showing as ?charged off? on my credit report.
-Americredit Account Number ********
-GMAC Mortgage ********
-BENFCL/HFC ********
-HSBC NV *******
Each of the above accounts were included in my Chapter 7 bankruptcy filed 12/01/2003 and discharged on 03/25/2004.
Section 607(b.) of the FCRA requires credit bureaus "to follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates." It is not a reasonable procedure to label an account that has been discharged in bankruptcy as "charged off as bad debt" if the account was open and not charged off when the consumer filed bankruptcy. Such a designation would be inaccurate or misleading, because it would indicate that the creditor had written off the account at the time of bankruptcy when it had not in fact done so.
It is important to note that two of the above account survived the bankruptcy and remain in good standing today.

I request that the above accounts to be verified to show accurate information, or be deleted from my credit file.

Reply:That letter will probably do two things:
1) Get the reporting changed to IIB
2) Cement the BK itself to your report for 10 years.
Whether that's good or bad depends on what you want to accomplish.
Were it me, I'd dispute as "incorrect status, not C/O" and see what they come back with.
Reply:Thanks, I tihnk I will do that first and see what happens. If they leave it as charge off, should I then go after the OC.

If it is still left at a CO with CBR's then go after to OC and get it updated. Then send a dispute for incorrect information to possible have it totally deleted?
